Ohio: do not assume the seller’s park license transfers.

Buying the real estate and being authorized to operate the park are related but different questions. Give licensing its own closing checklist.

01

Read the ownership rule

Ohio Administrative Code 4781-12-03 says a park license states the responsible person, park name and location, and maximum licensed number of manufactured homes. It also states that the license may not be transferred to a new owner upon sale or disposition.

02

Reconcile license, layout and rent roll

The practical control is to compare the licensed capacity with the physical site layout and income schedule. A count in a sales brochure is not, by itself, evidence of permission to operate that many sites.

Record discrepancies and obtain authoritative clarification before valuing expansion or filling vacant pads. Occupancy and licensing answer different questions.

03

Confirm the successor’s operating path

Chapter 4781-12 includes the park-license application rules. Use the current rule and division instructions to confirm the new operator’s submission, timing and required supporting information. Do not treat a seller’s signature on the purchase agreement as agency authorization.

04

Make the handoff explicit

Our proposed file includes the current license, recent inspection history, corrective-action correspondence, site-count reconciliation, successor entity information and a written responsibility matrix. Keep license work distinct from private utilities, home titles and real-estate closing documents.

This guide does not determine licensure for a specific transaction. Confirm the current procedure with the Ohio division and transaction counsel.
